1. Arrival / Departure
Arrival is generally only possible from 3:00 p.m. and departure is by 10:00 a.m. Other arrival and departure times can be agreed individually with the landlord. If the departure time is exceeded by 30 minutes without having agreed this with the landlord in advance, we will charge EUR 5 per 30 minutes. A pro rata refund of the rent due to early departure is generally not made.
2. Special requests and additional agreements
are generally possible. They require written confirmation from the landlord. Earlier arrival (EARLY CHECK IN) and later departure (LATE CHECK OUT) are also possible, fees are charged for this and must be registered and confirmed in advance.
3. Payment
Depending on the booking portal, payment must be made in one go or in partial steps. These guidelines are set by the respective portal and we have no influence on them. Bookings made directly or on our website can be billed in different ways. Please inform the landlord of this option. Additional costs for bed linen, towels, electricity, water, parking space and waste are not charged.
4. Resignation
You can withdraw from the contract at any time. The withdrawal must be made in writing. In the event of withdrawal, you are obliged to compensate us for any damage caused: You can cancel free of charge up to 7 days before arrival. In the event of a no-show, the guest will be charged the total price of the booking. You can provide a replacement person who will enter into your contract under the conditions stated. Written notification is sufficient.
5. Tenant's obligations
The tenant undertakes to treat the rented items (holiday apartment/house, inventory and outdoor facilities) with care. If damage occurs to the holiday apartment/house and/or its inventory during the rental period, the tenant is obliged to report this to the landlord immediately. Defects and damage discovered upon arrival must be reported to the landlord immediately, otherwise the tenant is liable for these damages. A reasonable period of time must be allowed for the repair of damage and defects. Claims arising from complaints that are not reported immediately on site are excluded. Complaints that are only received by the landlord at the end of the stay or after leaving the holiday home are also excluded from compensation. In the event of any disruptions in service, the tenant is obliged to do everything reasonable within the scope of his legal obligation to help remedy the disruption and to minimize any damage caused. On the day of departure, the tenant must remove personal items, clean and washed dishes must be stored in the kitchen cupboards and rubbish must be disposed of in the existing rubbish bins. The landlord is responsible for cleaning the holiday apartment.
6. Smoking ban
The holiday apartments are non-smoking apartments. Smoking in the apartments and in communal areas is strictly prohibited. This also applies to e-cigarettes, shishas, tobacco heaters and similar devices. Smoking on balconies and/or terraces is only permitted if appropriately marked and the door to the apartment is closed. In the event of a violation, Valerij Lautenschlager has the right to demand compensation from the guest for the additional necessary cleaning costs, including any loss of revenue from an unreasonable subletting of the apartment due to the incident, in the amount of at least EUR 250.00. This amount of compensation must nevertheless be set higher if greater damage is proven.
7. Ban on parties & gatherings
Noise must generally be avoided in the booked apartment, the communal areas and the surrounding area. Quiet hours must be observed from 10 p.m. to 6 a.m. ("quiet times"), unless different times are specified in the house rules. Parties and gatherings are strictly prohibited in apartments and communal areas. In the event of a violation, Valerij Lautenschlager has the right to demand compensation from the guest for the additional cleaning costs required, including any loss of revenue from the unreasonable subletting of the apartment due to the incident, in the amount of EUR 500.00. The right to further compensation is not affected by this.
Sensors for measuring decibels may be installed in the apartments. These sensors do not record voices or conversations, but are used to detect excessive volume. The outdoor area, parking lot and entrance are monitored 24/7 by video and stored in a cloud environment. Valerij Lautenschlager is entitled to cancel an active booking with immediate effect and to expel guests from the house if it becomes aware of violations according to points 1 and 2. There is no entitlement to a refund or partial reimbursement in these cases. Valerij Lautenschlager reserves the right to use the services of a third party, for example a security service, to enforce the house rules. Any costs incurred as a result of any intervention by a third party will be passed on to the guest.
8. Pets
Bringing (pet) animals is not permitted in apartments and common areas. Exceptions are guide dogs, deaf dogs and other similar service dogs. These can be brought along free of charge and at any time upon presentation of proof. The relevant proof must be presented to Valerij Lautenschlager independently before check-in. Valerij Lautenschlager is entitled to make further exceptions to the above principle. The guest is not entitled to this. If a pet stays in a unit without permission, Valerij Lautenschlager will charge a flat rate of EUR 150.00 for a special cleaning fee. Valerij Lautenschlager is entitled to cancel an active booking with immediate effect and to expel guests from the house if point 1 is violated. There is no entitlement to a refund or partial refund in these cases.
9. Maintenance
By booking an apartment from Valerij Lautenschlager, the guest undertakes to treat the apartment provided as well as the rooms, facilities and equipment intended for communal use with care and consideration, to ensure adequate ventilation and heating, and to avoid major soiling. If soiling that goes beyond normal use occurs during the guest's stay or after their departure, Valerij Lautenschlager has the right to charge the guest an additional cleaning fee of at least EUR 50.00 (depending on the condition of the unit). The guest must immediately report any damage to the apartment provided to Lautenschlager. For bookings of more than 7 nights, Valerij Lautenschlager is entitled to carry out weekly intermediate cleaning. The guest is obliged to grant the service provider commissioned by Valerij Lautenschlager access to the apartment for this purpose.
10. Internet use
Valerij Lautenschlager provides the guest with internet access within the scope of the existing technical and operational possibilities. Disruptions, for example due to force majeure or due to maintenance work or similar, cannot be ruled out. The guest may not misuse the internet connection. Misuse occurs in particular in the following cases: downloading and distributing copyrighted content via peer-to-peer sharing platforms, illegal streaming services and the posting, retrieving or transmitting of criminally relevant content (in particular §§ 130, 130a, 131 and 184 StGB). The guest is obliged to observe the copyright, patent, name, trademark and personal rights of third parties when using the service. The guest shall indemnify Valerij Lautenschlager upon first request from all claims and demands for damages from third parties as well as from the costs of legal defense in an appropriate amount that are caused by the illegal use of the internet connection provided by the guest or by third parties with the knowledge of the guest. This indemnification claim covers in particular claims arising from the violation of copyright, patent, name, trademark and personal rights as well as violations of data protection law. The guest is prohibited from passing on the access data for Valerij Lautenschlager's internet connection to third parties. This also applies to the publication of any access data. In the event of a violation, the guest is liable to Valerij Lautenschlager for all damages caused by the passing on of the access data. Valerij Lautenschlager also reserves the right to block the guest's internet connection in the event of legal violations.
11. Data Protection
The tenant agrees that, within the framework of the contract concluded with him, necessary data about him may be stored, changed and/or deleted. All personal data will be treated with absolute confidentiality and will never be passed on to third parties.
12. Liability
The advertisement was created to the best of our knowledge. We are not liable for any influence on the rental property due to force majeure, power and water outages and storms that are common in the country. We are also not liable for unforeseeable or unavoidable circumstances such as official orders, sudden construction work or disruptions due to natural and local conditions. However, the landlord will be happy to help resolve the problems (as far as possible). The landlord is not liable for the use of the play equipment provided. The tenant's arrival and departure are at his own responsibility and liability. The landlord is not liable for personal items in the event of theft or fire. The tenant is fully liable for deliberate destruction or damage.
13. Final provisions
Photos and text on the website or in the flyer serve to provide a realistic description. 100 percent correspondence with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the furnishings (e.g. furniture) provided they are of equivalent quality. Should one or more provisions of these terms and conditions be or become invalid, this will not affect the validity of the remaining provisions. The invalid provision is to be replaced by a valid one that comes closest to the economic and legal intention of the contracting parties. German law applies. The place of jurisdiction and place of performance is the place of residence of the landlord.
